    One energy player that's starting to move within range of triggering a major breakout trade is Midstates Petroleum (MPO), an independent exploration and production company focused on the application of modern drilling and completion techniques to oil-prone resources. This stock is off to a rough start in 2013, with shares off by 30%.

    If you look at the chart for Midstates Petroleum, you'll notice that this stock has recently come out of a nasty downtrend that took shares from over $8 to its low of $4.26 a share. Shares of MPO have started to find some buying interest over the last month at $4.44, 4.26 and $4.48 a share, as the stock has held those levels on recent pullbacks. This could be signaling that a bottom is forming for MPO, since the downside volatility looks over. Shares of MPO are now rebounding strong off those support levels and are quickly moving within range of triggering a major breakout trade.

    Traders should now look for long-biased trades in MPO if it manages to break out above some near-term overhead resistance levels at $4.82 a share and then once it takes out its 50-day moving average at $5.30 a share with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average action of 542,939 shares. If that breakout triggers soon, then MPO will set up to re-test or possibly take out its next major overhead resistance levels at $6 to its 200-day moving average of $6.54 a share.

    Traders can look to buy MPO off any weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support levels at $4.48 or $4.26 a share. One can also buy MPO off strength once it takes out those breakout levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.

    Investors got ugly on beauty supplier Sally Beauty Holdings (SBH) and shares tumbled 14.4% in trading after it reported a disappointing fiscal third quarter.

    For the period ended June 30, Sally Beauty reported earnings of $72.5 million, or of 42 cents a shares, up from $69.5 million, or 37 cents, a year prior. Sally Beauty also reported revenue of $912.1 million.

    Analysts polled by Factset forecasted earnings of $930.5 million.

    In a press release on the company�� website, Chairman and Chief Executive Officer Gary Winterhalter noted some of the headwinds from the quarter and said, ��tore traffic from the non-Beauty Club Card customer in the Sally U.S. business was soft. We��e launched several initiatives specifically to address this customer and remain optimistic that traffic will recover over the next few months.��/p>

    Shares are up 16% in the past year.

How To Avoid the Worst Banking Abuses

It wasn't too long ago that banks would do nearly anything to get your business and worked hard to keep it.  Imagine getting a toaster for opening an account! Oh boy, those were the days.

In the post-meltdown era, though, it doesn't seem like banks want small-change business like checking accounts. At nearly every turn, they impose fees to try to boost their profits. For account holders, it's incredibly annoying and costly.

The Pew Charitable Trusts recently released its fourth survey of checking account practices. While there's been some progress on disclosing the worst account abuses, there are still plenty of ways banks are going to gouge you. Here's what you need to know.

* Avoid Banks that "reorder consumer withdrawals from high to low-dollar amount." This practice, according to the Pew Trusts, can boost overdraft fees. Nearly half of the banks surveyed do this.

A responsible bank should give you clear, understandable disclosure on all fees. If there's gobbledygook in their disclosure statements, chances are you will get burned.

* Know What Triggers an Overdraft or Line of Credit. With my checking account, for example, I know that if my balance hits $100 or lower, my bank will automatically transfer money into my account using a line of credit. The overdraft fee is only $10.

Of course, you need to know how an overdraft is triggered and how much it will cost you per occurrence.  Fees can quickly add up.

* Know the Rules of Your Debit Card. Some banks allow you to overdraw your account through a debit card — triggering fees — while others don't. These rules should be clearly spelled out.

* Do You Have to Resolve Your Disputes Through Binding Arbitration? Like securities brokers, banks often make you sign agreements that say that disputes can only be resolved through arbitration.

That means settling out of court in a forum you may not understand. Know the terms of your arbitration agreement. The devil may be in the details.

* Know the perils of pre-paid debit cards. The idea of these products was simple: You load money into them and use them as you please for cash payments.

Yet pre-paid debit cards can be expensive. Banks can charge you for "re-loading" the card, activation, maintenance and even asking for your account balance. Bankrate.com recently did a survey of these cards and identified some of the most obnoxious fees.

The antidote for onerous bank fees is shopping around. You don't need a pre-paid debit card if you can find a free checking account that gives you an ATM card. You may not need overdraft protection if you monitor your balances constantly. Check with your local bank, savings and loan or credit union. You might find a better deal close to home.

But of course that's not true. As a customer, you can simply stop giving the company your business. If you're a shareholder, you can vote for or against various proposals for the company. And if those options don't feel like enough, there's another way to voice your displeasure -- a tactic that is growing in popularity and is truly bring about changes: You can start or sign a petition. If your first reaction to that is, "Nonsense, petitions never accomplish anything," your skepticism is understandable. But it's a little out of date. Social media has changed the petition game as it has changed so many other things. Banding Together for Change By now, you've probably seen petitions pop up on your Facebook (FB) page. You might have even signed some. But we don't often hear what happens next. In many cases, they work. For example, 162,150 people signed a petition protesting the name of a Jacksonville, Fla., high school, which had been named in the 1950s after a slave trader and Ku Klux Klan member, and the school board has agreed to change its name at the start of the new school year. Changes can happen at big companies, too. More than 307,000 petitioners were successful in getting Tyson Foods (TSN), the second-largest food-production company in the Fortune 500, to "stop torturing pigs." The company announced new animal-welfare guidelines for its pork suppliers, requiring more room for pigs to move around and more humane methods of killing the animals. Abercrombie & Fitch (ANF) is another example. It had long been criticized for policies such as not offering clothing in larger sizes and making someone's looks a major hiring criteria in order to distance itself from anyone other than "cool, good-looking people." The company has finally agreed to start offering plus-size clothing, likely persuaded in part by more than 80,000 people signing a petition urging Abercrombie to change its ways. SeaWorld Entertainment (SEAS) has come under fire lately for its treatment of captive killer whales, publicized in the disturbing documentary "Blackfish," which is now streaming on Netflix (NFLX). Disillusionment with SeaWorld seems to be growing, with it experiencing some traffic shrinkage. At Change.org, a petition asking singer Willie Nelson to cancel an appearance there worked, with fewer than 10,000 signers. Other similar efforts have led many other performers to drop Seaworld gigs. Sprint (S), petitioned by more than 175,000 people, agreed to improve its policies to keep domestic-violence victims safer. Verizon (VZ) did as well. Part of the problem were steep fees faced by those who were trying to separate themselves from joint accounts with abusers. Even Facebook, which is used to spread many petitions, was itself the subject of a successful petition, with the company agreeing not to censor images of women who have had mastectomies. In the Americas, the Company sells aftermarket transportation products through various distribution channels, including mass merchandisers, auto parts outlets, wholesale distributors, and battery specialists. The Company sells its OEM transportation replacement products principally through dealer networks. The Company�� Americas operations include a network of 74 branches which sell and distribute batteries and other products to the Company�� distributor channel customers, battery specialists, national account customers, retail stores, and OEM dealers. In addition, these branches collect spent batteries for the Company�� recycling facilities. These operations supply recycled lead for approximately 75 to 80% of Exide�� Transportation and Industrial Energy products manufactured in North America. Exide supplies its OEM batteries directly to the assembly plants of its customers. The Company also delivers service and replacement batteries into this segment. Caterpillar (NYSE: CAT  ) is today's worst Dow stock, down 2.7% after it reported earnings per share of $1.45 -- a full 40% below the prior-year quarter's $2.54 and well short of analyst expectations of $1.71. Revenue came in at $14.6 billion, down 16% from a year ago and below analyst expectations of $14.9 billion. On top of the disappointing earnings, the company also cut its forecast for 2013 EPS from $7 to $6.50 and lowered its revenue guidance from $56 billion-$58 billion to $57 billion-$61 billion.     Janet S. Carter/AP Dollar General (DG) upped its bid for the rival Family Dollar chain and addressed an earlier roadblock, saying that it will more than double the number of stores it would shed to tamp down the antitrust concerns of its takeover target. The newest bid is worth $9.1 billion, or $80 a share, up from $78.50 a share in the previous offer. Family Dollar (FDO), based in Matthews, North Carolina, rejected the earlier bid in favor of a lesser offer of $8.5 billion from Dollar Tree (DLTR), saying that regulators were less likely to stand in the way. On Tuesday Dollar General, the country's largest dollar-store chain, said it would divest as many as 1,500 stores, well above the 700 that it had originally agreed to, in order to sidestep any anti-monopoly actions that regulators might pursue. The Goodlettsville, Tennessee, company has also said it will pay a $500 million reverse break-up fee to Family Dollar Stores if the deal hits antitrust roadblocks. Dollar General Chairman and CEO Rick Dreiling said that a second antitrust review supported its prior bid, but that its offer was revised "to demonstrate the seriousness of our commitment." The businesses of Family Dollar and Dollar General are more similar than Dollar Tree's. The first two sell items at a variety of prices while at Dollar Tree, all items are a buck. Family Dollar has been looking for a lifeline after running into some financial stress, shuttering stores and cutting prices. In June one big shareholder, Carl Icahn, urged the company to put itself up for sale. Family Dollar acted one month later, accepting an offer from Chesapeake, Virginia-based Dollar Tree of $59.60 in cash and the equivalent of $14.90 in shares of Dollar Tree for each share held. The companies valued the transaction at $74.50 a share at the time. Including debt and other costs, Family Dollar and Dollar Tree estimated the deal to be worth approximately $9.2 billion. Shares of Family Dollar added 54 cents to $80.

    Halliburton (NYSE: HAL  ) �and�Schlumberger (NYSE: SLB  ) �are two larger competitors with market capitalizations two and five times that of Baker Hughes, respectively. Schlumberger, which is the industry leader, trades at the highest valuation multiples: 2.7 times 2012's annual revenues and 21 times earnings. Halliburton and Baker Hughes trade at lower and more acceptable earnings ratios of around 18 times earnings for 2012. Note that these competitors have seen rapid growth and margin expansion in recent years as well.

    Schlumberger (SLB) was down in Thursday afternoon trading after a mixed first quarter.

    The oilfield giant said first quarter earnings were $1.59 billion, or $1.21 a share, up from 94 cents in the year-ago period and one penny ahead of estimates. Revenue rose 6.3% to $11.24 billion, just below the $11.49 billion analysts were expecting.

    The Middle East and Asia a was the strongest region, with sales up 19%, followed by North America, with 12%. Revenue edged ahead by 0.6% in Europe and Africa, while Latin America saw a 7.7% decline.

    Stephens analyst Michael Marino reiterated an Overweight rating on the stock: ��hile SLB’s geographically diversified footprint will likely limit exposure to the accelerating margin trends in North America this year, global oilfield spending continues to grow at a modest pace. Overall, we continue to see slow and steady revenue growth for the Company and solid incremental margins on higher deepwater mix, overall efficiency gains and potential pricing gains in North America.��/p>
